Zacky Zainal Husein

With more than 20 years' experience in the Indonesian legal sector, Zacky holds an undergraduate degree in law from the University of Indonesia, a master's degree in law from Georgetown University in Washington DC, and a master’s degree in public management from the National University of Singapore/Harvard University.

Zacky joined AHP as a partner on 1 October 2014 and has assumed the lead role in AHP’s growing technology, media & telecommunications (TMT) practice. Aside from providing regulatory advisory and preparing documentation on stand-alone TMT transactions, the TMT practice also provides substantive input on transactions managed by related practices at AHP, such as Mergers & Acquisitions, Banking & Finance, Capital Markets, and Competition. Zacky is also the primary author of AHP’s client updates on TMT matters.

Among the key TMT matters that Zacky has been involved with are:

  • network sharing by telecommunications operators and service providers (including Mobile Virtual Network Operators/MVNOs);
  • telecommunications infrastructure and submarine cables;
  • protection of personal data (data privacy);
  • provision of app and content (videos, news, games, social media) services through the internet (over the top/OTT services);
  • electronic commerce framework and ecosystem;
  • financial technology and payment gateway;
  • unauthorized access and cyber security; and
  • data processing, storage, and analytics.

Aside from advising and representing clients, Zacky has been active in providing substantive input during the discussion stages for various draft regulations being prepared by the Government – for example, regulations on network sharing and OTT services. Zacky also regularly speaks at industry and public seminars, in-house counsel forums, and corporate events related to TMT issues.

Prior to joining AHP, Zacky was Group Head Legal at one of Indonesia's largest cellular providers, PT Indosat Tbk., where he led a team of in-house lawyers in managing a telecommunication company's traditional cellular and fixed line services, as well as the shift to a service with greater emphasis on data, and collaborations with start-up app-developers, global internet players, and OTT companies. Zacky was also involved in major litigation involving an Indosat subsidiary, where the main point of contention revolved around the interpretation of frequency spectrum utilization, which highlighted the urgent need to update the Telecommunications Law.

Before taking up employment with Indosat, Zacky served as a member of the Reducing Emissions from Deforestation and Forest Degradation (REDD+) Task Force, a body that is directly accountable to the President of Indonesia, where he was a member of the Legal Review and Law Enforcement Unit. Prior to that, he practiced law successively in a number of top-tier Jakarta law firms, focusing on banking and finance, structured finance/derivatives, competition, infrastructure, mining (coal and extractive minerals), oil & gas, forestry and general corporate. Zacky also managed the law programs of The Asia Foundation in Indonesia from 2000-2005, working on legal reform and development efforts in the justice sector post the Soeharto era.
