Wisnu Wardhana

Wisnu joined Assegaf Hamzah & Partners in 2013 after having completed his master’s degree at Erasmus University Rotterdam, where he majored in Commercial Law. Prior to joining the firm, he worked for Rizkiyana & Iswanto, a leading Indonesian boutique antitrust firm, in which he was involved in various antitrust matters, ranging from antitrust litigation to merger notification. Among the high-profile cases he has worked on are PT Dexa Medica vs. the Indonesian Competition Authority (KPPU), where the District Court overturned the KPPU's determination that Dexa had been part of a pharmaceuticals cartel, and PT Perusahaan Listrik Negara (Persero) vs. KPPU and PT Perusahaan Gas Negara Tbk. vs. KPPU, where he was a member of the team that successfully defended the two major state-owned companies in the Supreme Court against an allegation of bid-rigging.

With a deep interest in antitrust law, Wisnu now focuses his practice primarily on antitrust litigation and advisory work. Some recent cases that he worked on are Minister of Trade vs. KPPU, where he defended the Ministry of Trade against an allegation of conspiratorial anti-competitive behavior involving garlic imports, and PT Goodyear Indonesia vs. KPPU in respect of an alleged cartel involving tire manufacturers. In other recent KPPU investigations, Wisnu assisted a major automotive manufacturer in the investigation of an alleged cartel and defended a large state-owned company against an allegation of bid-rigging in the fertilizer industry.

On the merger notification side, Wisnu has worked on a number of significant domestic and foreign mergers notifications to the KPPU, including on behalf of GDF Suez SA (acquisition of International Power Plc), Lafarge SA (acquisition by Holcim Ltd) and PT XL Axiata Tbk (acquisition of PT Axis Telecom Indonesia). He also frequently advises on antitrust issues in a wide variety of industrial sectors. He has also worked on competition due diligence reviews for Clariant AG, Beiersdorf AG, PT Frisian Flag Indonesia and PT Unilever Indonesia Tbk., and advised PT Garuda Indonesia Tbk in connection with its membership of the SkyTeam alliance. In addition, he was a member of the team that provided antitrust compliance training to Menarini Asia-Pacific Holdings Pte. Ltd.

Passionate about the development of antitrust law, Wisnu also finds time to work as a legal researcher at the Indonesian Competition & Consumer Law Society, a non-profit and non-governmental institution, where he was involved in drafting Competition Guidelines in the Indonesian Upstream Oil and Gas, published by Indonesia’s Upstream Oil and Gas Regulator (BPMIGAS/SKK MIGAS). Outside his legal practice, he has contributed to several publications, including The Asia-Pacific Antitrust Review 2012 – Overview: Indonesia and Merger Control 2012 – Indonesia chapter, published by Global Competition Review, and, most recently, Indonesian Competition Law, which was published by LexisNexis in 2014. He also recently acted as a facilitator during antitrust litigation training hosted by Hukum Online.
