Intellectual Property

Our rapidly expanding IP practice is making its mark in an area of the law in Indonesia that has traditionally been dominated by boutique law firms which have tended to focus narrowly on specific aspects, rather than on the bigger picture. By contrast, as a full-service law firm, we offer everything you need to register, protect and enforce your intellectual property rights. We are as much at home with the contentious as the non-contentious aspects of IP.

IP has come a long way in Indonesia since the days when domain squatting and other abuses were rife (although new abuses continue to crop up from time to time). The country’s IP regime is now broadly compliant with TRIPs and WTO requirements, while government’s determination to further bring it up to scratch is evidenced by the passage of a comprehensive new Copyright Law in 2014 and the imminent ratification of the Madrid Protocol.

Our IP Practice is headed by senior advocate and AHP Partner Chandra Hamzah, while Ms. Zoraida Syarfuan serves as IP Practice Director, coordinating the work of five specialist IP lawyers and a number of paralegals with expertise in IP matters.

Zoraida graduated with a Bachelor of Law Degree from the University of Indonesia in 1992, before going on to earn her LL.M. in Asian Comparative Law from the University of Washington, Seattle, United States, in 1994. She joined AHP in early 2015.

Prior to joining the firm, she worked with another major law firm in Jakarta and also spent a number of years as an associate in charge of the Asia desk with a major law firm in New York City. Besides her IP expertise, she has extensive experience in general corporate and commercial, foreign direct investment and media & telecommunications law.

For his part, Chandra, with some than 20 years practicing at the bar, is one of the pioneers of modern IP law in Indonesia. He was a founder member and first chairman of the Indonesian Association of Intellectual Property Lawyers. He also served as vice chairman of the Central Jakarta branch of the Indonesian Bar Association (IKADIN) from 2003 to 2007, vice chairman of the Indonesian Chamber of Commerce and Industry (KADIN)’s Legal Division (2005-2007), and chairman of the Indonesia Association of Intellectual Property Attorneys (2006 – 2007). One of the leading intellectual forces in Indonesian law, Chandra was a co-founder of the Centre for Indonesia Law and Policy Studies (PSHK) in 1998.

Currently with a total of 7 dedicated IP lawyers, we also provide access to an arsenal of some 30 lawyers with general IP experience in our Disputes Dept., as well as an arsenal of IP lawyers throughout the Southeast Asia region through our membership of the Rajah & Tann Asia Network. As one of Indonesia’s top 3 law firms (according to Singapore-based Asian Legal Business magazine), we have experience representing clients across the entire economic spectrum, including blue-chip local and foreign investors, state-owned enterprises, foundations, and tech start-ups.
